What is AFSPA?

The Armed Forces Special Powers Act (AFSPA) is an act passed by the Parliament of India which gives special powers to the Indian armed forces operating in “disturbed areas”. The act applies to seven states of India - Assam, Manipur, Nagaland, Mizoram, Tripura; certain parts of Arunachal Pradesh; parts of Meghalaya bordering Assam and certain parts of Jammu & Kashmir. These areas are declared as “disturbed areas” under Section 3 of the AFSPA which enables the armed forces to undertake any action they deem necessary for restoring peace.

Why was AFSPA created?

The AFSPA came into being after several decades of tension between the Government and separatist groups during which time many civilian lives were lost due to violent clashes between them. It was meant to provide extra legal protection to the armed forces deployed in these conflict zones so that they could carry out their duties without fear of prosecution for any action taken against civilians or insurgents during their duty hours. The Act also provided a framework within which those accused of serious offences such as murder, rape etc., could be tried by military courts rather than civil courts where they would usually receive lesser penalties than if convicted in a civilian court.

Main controversy and implications

The main controversy surrounding AFSPA is its provisions for granting immunity from prosecution for personnel operating in disturbed areas and also its lack of provisions for accountability if rights violations occur while carrying out operations under this act. Numerous allegations have been made by human rights organizations over the years claiming that members of the armed forces had used force excessively often leading to loss of civilian life. This has led victims filing cases before various courts demanding justice but most cases have been dismissed due to lack of evidence or because no proof was presented before courts showing any illegal acts committed by servicemen operating under this law. The law has also been criticized for ignoring local laws while providing absolute power to soldiers including making arrests without warrants besides allowing searches without consent among other things all leading to increased tensions between locals and military personnel stationed there leading further deterioration peace situation instead improvement it aims at achieving.
